Michigan House Freedom Caucus abhors new “red flag” bills; warns of unintended consequences

The Michigan House Freedom Caucus has issued a statement in opposition to so-called “red flag” laws, which infringe on the Second Amendment rights of law-abiding citizens.

Michigan’s new red flag bills, also known as extreme risk protection orders (ERPO), allow any individual to petition a court in any county to remove firearms from individuals whom they deem a danger to themselves or others. The laws have gained support in the wake of mass shootings and instances of gun violence. However, the House Freedom Caucus warns that red flag laws undermine the fundamental rights guaranteed by the Federal and State Constitutions.

The Caucus also argues that red flag laws could be abused by those with a political agenda. “There is a real risk that these laws could be used to target law-abiding citizens who hold unpopular views,” said Rep. Angela Rigas (R-Caledonia). “By allowing people to file for an ERPO in any county, the Democrats are encouraging the disgusting practice known as Court Shopping. We cannot allow Michigan to become a breeding ground of fear and mistrust.”

“We need to address the root causes of violence, not infringe on the rights of law-abiding citizens,” said Rep. Joseph Fox (R-Fremont).

Rep. James DeSana (R-Carleton) adds, “This is a violation of the due process rights of law-abiding Michiganders. The mere fact that someone may ‘unintentionally harm’ themselves is not a sufficient reason to deny Constitutional rights.”

The House Freedom Caucus is committed to protecting the Constitution and the rights of all Americans. They urge their colleagues to reject red flag laws and work towards common-sense solutions that address the underlying issues of gun violence.
